Terms of Service

By signing up for and/ or otherwise accessing any of the services or products offered by Nineten New Media Limited you agree to be bound by all the Terms and Conditions listed here. These Terms and Conditions supersede all earlier versions. To the extent that You are deemed to be a consumer as defined by the Unfair Contract Terms Act 1977 or the Unfair Terms in Consumer Contracts Regulations 1999 (UTCCR), these conditions will not affect Your rights and will only apply to the extent that applicable law allows.

Domain Names

Domain names purchased on YOUR behalf in good faith by Nineten New Media Limited, are fully owned by YOU subject to full payment of the domain pruchase invoice being paid within 30 days of receipt of said invoice.

As consideration for Nineten New Media Limited providing domain name registration services to you, you agree to pay Nineten New Media Limited the desired domain name registration fee, the amounts set forth in the Price List, as amended from time to time, for the initial registration of the domain name and any subsequent renewals.

If Nineten New Media Limited does register a domain name and full payment is not made by YOU, Nineten New Media Limited reserves the right to cancel that registration or restrict use of the domain name until payment has been received.

All fees must be paid in full and are non-refundable, in whole or in part, even if the domain name registration is suspended, cancelled or transferred prior to the end of the registration term.

Nineten New Media Limited may reinstate your domain name registration at its sole discretion upon its receipt of the registration or renewal fee and its then current reinstatement fee. The reinstatement fee is currently £100+vat.

Invoices outstanding for a period greater than 5 working days, will result in YOUR service being suspended and furthermore, Nineten New Media Limited will refer the account to a debt collection agency and inform credit reference agencies. This may seriously affect your ability to obtain credit in the future.

Hosting & Email Accounts

In agreement with YOU, Nineten New Media Limited will create a hosting/email account on YOUR behalf for your use. Each hosting/email account is renewable annually from the initial start date.

If charges relating to your hosting account (or any additional products associated with the hosting account) are outstanding for a period greater than 5 working days, your service will be suspended and furthermore, Nineten New Media Limited will refer the account to a debt collection agency and inform credit reference agencies. This may seriously affect your ability to obtain credit in the future.

All hosting accounts purchased are subject to a 12 month minimum contract term.

Nineten New Media Limited reserves the right to suspend or cancel a customer's access to any or all services provided by Nineten New Media Limited, where Nineten New Media Limited decides that the account has been inappropriately used. Nineten New Media Limited reserves the right to refuse service and/or access to its servers to anyone.

Sites must not contain Warez, copyright or other illegal material. The onus is on YOU the customer to prove that you own the rights to publish material, not for Nineten New Media Limited to prove that you do not.

Sites must not contain pornographic or other lewd material. Adult Material includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Nineten New Media Limited.

Sites must not use excessive amounts of server resources. These include bandwidth, processor utilization and / or disk space.

Sites must not contain scripts that attempt to access privileged server resources, or other sites on the same server.

Email: If Nineten New Media Limited identify a mailbox that is causing problems; we will either remove the offending mailboxes or change their settings to resolve the issue. In extreme cases, we will disable email or suspend all services to the domain as appropriate.
